The first stage of any case is an investigation as to whether you are in fact guilty of a motoring offence such as drink driving or caught speeding.

Just because you have been charged with an offence, it does not always mean that you have committed the offence. All machines can go wrong. Sometimes these problems are due to the device and sometimes it can be operator error, but the start of any case begins with an investigation as to whether you actually committed the offence. If there has been an error it may be that the Crown Prosecution Service could decide not to continue with the prosecution.

If it is shown that the device (such as a speed camera or drink driving breath test) is reliable we can investigate the procedure carried out. The law still allows you to put the prosecution to proof of their case and if the police or prosecuting authority has made fundamental errors in a case the Courts may feel that it is unfair that you be convicted of that offence. We look at every case with a fine tooth comb but if all else fails we will always be on hand to ensure that a fair result will be obtained if the court is considering penalty points or a driving ban.
