Can you help me if I have already lost my case at Court?
If you were represented by another solicitor or tried to defend yourself and were unsuccessful we would be happy to pick up the case and add our own unique brand of motoring law defence to your case.
You need to be aware that following an unsuccessful case you only have 21 days to inform the Court and the Prosecutor of your intention to appeal.
Can I appeal if the 21 days has elapsed?
The Court does have discretion to grant you leave to appeal out of the 21 day time limit but there would need to be a reason and the longer you go outside of the timescale the more likely you are to be refused leave to appeal.
Can I appeal a sentence?
You have the right to appeal a sentence passed by a Magistrates Court if you feel you have been dealt with harshly or unfairly. With good representation a sentence can be reduced but professional advice should always be sought as the Court has the power to increase a sentence instead.
Can I get my licence back whilst I wait for my appeal?
The Court has the power to suspend a disqualification pending the outcome of an appeal. It can be argued that it would be unfair for a disqualification to be imposed,
as if your appeal is successful you would have already been unable to drive for a substantial part of your sentence if not all of it.
