Do I need a solicitor?
Choosing whether or not to be represented is a personal choice. Our advice would
be yes you should always be represented by a solicitor whilst in custody or
giving a police interview. A solicitor can make a world of difference at a
police station. Solicitors with knowledge of road traffic law can start the
defence of your case at the police station stage and this can make a huge
difference further down the line. A solicitor can also help protect your rights
at a police station and if you do end up sat in a cell waiting upon the police
to take some action it is very reassuring to know someone is working on your
behalf. You should be aware that when returning to a police station you can be
taken into custody and interviewed or re-interviewed. This is common as the
police have had a chance to assess what they wish to find out from you and they
also will have spoken to other witnesses and may wish for your input.
Will the police wait until my Solicitor arrives?
Police officers will wait for a solicitor before they interview you but they will
not delay the breath test procedure. If you feel that you would prefer to wait
for advice before providing a sample you will probably find yourself charged
with
failure to provide
a specimen. People often refuse to attempt to provide a sample for many
reasons the main one being the fact that you were not the driver. This is
something that can be straightened out at Court but the police have the right to
request a sample even if they only suspect that you were the driver. Therefore
if you are unsure as to whether you should attempt to provide a specimen our
advice is that you should provide the sample.
Can I be helped over the telephone whilst at a police station?
You can ask to speak to a solicitor over the telephone and the police will
facilitate this request. The police will ask if you have your own solicitor or
wish to have a duty solicitor. You can speak to a solicitor on the scheme for
advice but if you have our number you can contact a specialist road traffic
solicitor without any cost to yourself. Why not put the number in your phone
